Billboards Advertise Sex Shops in the “Show me State”
A three-judge panel on the 8th Circuit says the effort to protect kids from seeing the questionable signs is unconstitutional.
Missouri’s law banned sexually suggestive billboards within a mile of state highways. The sex shops sued saying the law was too broad, and won. Gene with Passion’s Adult Video told KMBC he was pleased.
“This is overthrown. Hopefully they will realize they can’t go on a wild-expedition like this. We’ll continue to advertise in a tasteful way as we always have.”
Phillip Cosby with the National Coalition for the Protection of Children and Families says the court’s decision is bad news for parents who have to explain the signs tawdry messages to their children.
“You can be going along there with your kids and what you should be enjoying, now you have to apologize and embarrassingly comment, perhaps to the kids’ questions, as to ‘why don’t we ever go into those places mom or dad?’”
While the state appeals the decision, lawmakers are re-working the legislation sponsored by Senator Matt Bartle. His spokesman is Todd Scott.
“We will be coming back on December 1st of this year to re-write the law to narrowly tailor in accordance with the courts decision, and we believe we can craft a law that will withstand constitutional muster and will be able to be withheld next time this goes up for appeal.”
The law, which took effect in August 2004, sought to reduce the possible negative effects that sexually suggestive billboards supposedly posed including harming minors, reducing traffic safety and dropping property values.
Law Restricts Sex Shops
Fairway City Council passed an ordinance 8-0 governing sexually oriented businesses Aug. 14
The ordinance does not prohibit such businesses from operating in Fairway, but defines sexually oriented businesses and outlines regulations for owners and employees.Businesses classified as sexually oriented include adult entertainment studios, adult encounter parlors, adult motels, bath houses and body painting studios.
According to the ordinance, sexually oriented businesses may not operate within 1,000 feet of any childcare facility, church or school. The businesses must also remain at least 300 feet from any public park or property zoned or used for residential purposes.
Licensing must be obtained to operate or work in a sexually oriented business at costs of $250 per business and $30 per employee. Licenses must be purchased annually and are nontransferable. Applications must be filed with the city clerk.
Those applying for sex shop licensing must provide their name, any stage names, date and place of birth, home telephone number and Social Security number at the time of application.
"This ordinance allows us to put on the brakes if sex shops were to attempt to locate in Fairway and analyze if forbidding them from coming to town would indeed violate their rights to free speech," Councilman Dane Lee said. "The fair thing to do is have an ordinance that recognizes there are certain types of businesses that need to be regulated in a little bit different way." Lee first suggested such an ordinance in fall 2005.
"It's one of those things I ran across and realized that we didn't have what I thought was a fairly commonplace ordinance," Lee said.
The ordinance references 22 studies outlining the adverse secondary effects sexually oriented businesses have on communities. The studies tie higher crime rates and sexually transmitted diseases to communities with sexually oriented businesses.
